Ziemi services BV cares a lot about your privacy. Therefore, we only process data that we need for (improving) our services and handle carefully the information we have collected about you and your use of our services. We never provide your data to third parties for commercial purposes.

This privacy policy applies to the use of the website and the services provided by Ziemi services BV. The effective date for the validity of these terms is 01/01/2023, and with the publication of a new version, the validity of all previous versions expires. This privacy policy describes what data about you is collected by us, how this data is used, with whom and under what conditions this data may be shared with third parties. We also explain how we store your data, how we protect your data against misuse, and what rights you have regarding the personal data you provide to us.

Below you can read how we process your data, where we store it (or have it stored), which security techniques we use, and who has access to the data.

Shopify

Onze webwinkel is ontwikkeld met software van Shopify. Persoonsgegevens die u ten behoeve van onze dienstverlening aan ons beschikbaar stelt, worden met deze partij gedeeld. Shopify heeft toegang tot uw gegevens om ons (technische) ondersteuning te bieden, zij zullen uw gegevens nooit gebruiken voor een ander doel. Shopify is op basis van de overeenkomst die wij met hen hebben gesloten verplicht om passende beveiligingsmaatregelen te nemen. Deze beveiligingsmaatregelen bestaan uit de toepassing van SSL-encryptie en een sterk wachtwoordbeleid. Shopify is een gecertificeerde verwerker van creditcardgegevens. Shopify maakt gebruik van cookies om technische informatie te verzamelen met betrekking tot uw gebruik van de software, er worden geen persoonsgegevens verzameld en/of opgeslagen. Shopify behoudt zich het recht voor om verzamelde gegevens binnen het eigen concern te delen om de dienstverlening verder te verbeteren. Shopify houdt rekening met de geldende wettelijke bewaartermijnen voor (persoons)gegevens. Het EU/US Privacy Shield is van toepassing, uw gegevens worden mogelijk in de Verenigde Staten verwerkt.

Hostnet

We use web hosting and email services from Hostnet. Hostnet processes personal data on our behalf and does not use your data for its own purposes. However, this party may collect metadata about the use of the services. These are not personal data. Hostnet has taken appropriate technical and organizational measures to prevent loss and unauthorized use of your personal data. Hostnet is obliged to confidentiality under the agreement.

Gmail

We use the services of Gmail for our regular business email communication. This party has taken appropriate technical and organizational measures to prevent abuse, loss, and corruption of your and our data as much as possible. Gmail does not have access to our mailbox, and we treat all our email communication confidentially.

Shopify Pay

Voor het afhandelen van een (deel van) de betalingen in onze webwinkel maken wij gebruik van het platform van Shopify Pay. Shopify Pay verwerkt uw naam, adres en woonplaatsgegevens en uw betaalgegevens zoals uw bankrekening- of creditcardnummer. Shopify Pay heeft passende technische en organisatorische maatregelen genomen om uw persoonsgegevens te beschermen. Shopify Pay behoudt zich het recht voor uw gegevens te gebruiken om de dienstverlening verder te verbeteren en in het kader daarvan (geanonimiseerde) gegevens met derden te delen. Shopify Pay deelt in het geval van een aanvraag voor een uitgestelde betaling (kredietfaciliteit) persoonsgegevens en informatie met betrekking tot uw financiële positie met kredietbeoordelaars. Alle hierboven genoemde waarborgen met betrekking tot de bescherming van uw persoonsgegevens zijn eveneens van toepassing op de onderdelen van Shopify Pay's dienstverlening waarvoor zij derden inschakelen. Shopify Pay bewaart uw gegevens niet langer dan op grond van de wettelijke termijnen is toegestaan. 

Vasco Fulfilment and PostNL

When you place an order with us, it is our responsibility to have your package delivered to you. We use the services of Vasco and PostNL for carrying out the deliveries. Therefore, we need to share your name, address, and city information with Vasco and PostNL. Vasco and PostNL only use this data for the purpose of executing the agreement. In the event that Vasco and PostNL engage subcontractors, Vasco and PostNL also provide your data to these parties.

Exact

For the maintenance of our administration and accounting, we use the services of Exact.nl. We share your name, address, and place of residence information, as well as details regarding your order. This data is used for the administration of sales invoices. Your personal data is sent and stored securely. Exact is obliged to confidentiality and will treat your data confidentially. Exact does not use your personal data for purposes other than those described above.

General purpose of the processing

We use your data solely for the purpose of our services. This means that the purpose of the processing is always directly related to the assignment you provide. We do not use your data for (targeted) marketing. If you share data with us and we use this data to contact you at a later time - other than at your request - we will explicitly ask for your permission. Your data is not shared with third parties, except to comply with accounting and other administrative obligations. These third parties are all bound by confidentiality based on the agreement between them and us or by an oath or legal obligation.

Automatically collected data

Data automatically collected by our website is processed with the aim of further improving our services. This data (such as your IP address, web browser, and operating system) is not personal data.

Cooperation in fiscal and criminal investigations

In cases where necessary, Ziemi services BV may be obligated to share your data due to a legal requirement related to fiscal or criminal investigations by the authorities. In such a situation, we are compelled to share your data, but we will resist it within the limits allowed by the law.

Retention periods

We will keep your data as long as you are a client of ours. This means that we will keep your customer profile until you indicate that you no longer wish to use our services. If you inform us of this, we will also consider it as a request to be forgotten. This also means that we will not keep your data for longer than two years from the last contact moment or transaction, unless there is a legal justification for it. Based on applicable administrative obligations, we are required to keep invoices with your (personal) data, so we will keep this data for as long as the applicable term runs. However, employees will no longer have access to your client profile and documents that we have produced as a result of your order.

Under the current Dutch and European legislation, you as a data subject have certain rights regarding the personal data processed by or on behalf of us. We will explain below what these rights are and how you can invoke them. In principle, to prevent abuse, we only send copies of your data to your email address already known to us. In case you wish to receive the data at a different email address or by post, we will ask you to provide identification. We keep a record of processed requests, and in the case of a request for erasure, we keep anonymized data. All copies of data will be provided in the machine-readable data format used within our systems. You have the right at all times to file a complaint with the Dutch Data Protection Authority if you suspect that we are using your personal data inappropriately.

Right of withdrawal

You always have the right to access the data that we (have) processed or that are related to you or can be traced back to you. You can make a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you a copy of all data, along with an overview of the processors who have this data, to the email address we have on file, specifying the category under which we have stored this data.

Right of rectification

You always have the right to have the data that we process (or have processed) and that relate to your person or can be traced back to you, adjusted. You can make a request to that effect to our privacy contact person. You will then receive a response to your request within 30 days. If your request is granted, we will send you a confirmation that the data has been adjusted to the email address we have on file.

Right to restriction of processing

You always have the right to restrict the processing of data related to your person or identifiable as such, which we (have) processed. You can make a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation to the email address we have on file, stating that the data will no longer be processed until you lift the restriction.

Right to data portability

You always have the right to have the data that we process (or have processed) and that relate to your person or are traceable to you, carried out by another party. You can make a request to this effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you copies or duplicates of all data about you that we have processed or that have been processed on our behalf by other processors or third parties, to the email address we have on file. In all likelihood, in such a case, we will no longer be able to continue providing services, as the secure linking of data files can no longer be guaranteed.

Right of objection and other rights

In case of any objections, you have the right to object to the processing of your personal data by or on behalf of Ziemi services BV. If you object, we will immediately cease the data processing pending the handling of your objection. If your objection is justified, we will provide you with copies of the data we (have) processed and then permanently cease the processing. You also have the right not to be subject to automated individual decision-making or profiling. We do not process your data in a way that this right applies. If you believe otherwise, please contact our privacy contact person.

Google Analytics

Through our website, cookies are placed by the American company Google, as part of the "Analytics" service. We use this service to keep track of and receive reports on how visitors use the website. This processor may be required to provide access to this data based on applicable laws and regulations. We collect information about your browsing behavior and share this data with Google. Google may interpret this information in conjunction with other datasets and thus track your movements on the internet. Google uses this information to offer targeted advertisements (Adwords) and other Google services and products.

Third-party cookies

In case third-party software solutions use cookies, this will be mentioned in this privacy statement.

Changes to the privacy policy

We reserve the right to change our privacy policy at any time. However, you will always find the most recent version on this page. If the new privacy policy affects the way we process data already collected about you, we will inform you by email.
