Ziemi Services BV takes your privacy very seriously. We therefore only process data that we need to provide and improve our services, and we handle the information we have collected about you and your use of our services with care. We will never make your data available to third parties for commercial purposes.

This privacy policy applies to the use of the website and the services provided by Ziemi services BV via that website. These terms and conditions come into effect on 01/01/2023; upon publication of a new version, all previous versions cease to be valid. This privacy policy describes what data we collect about you, what this data is used for, and with whom and under what conditions this data may be shared with third parties. We also explain how we store your data, how we protect your data against misuse, and what rights you have regarding the personal data you have provided to us.

About data processing

Below you can read how we process your data, where we store it (or have it stored), which security techniques we use, and who has access to the data.

E-commerce software

Shopify.

Our online shop has been developed using Shopify software. Personal data that you provide to us for the purposes of our services is shared with this party. Shopify has access to your data in order to provide us with (technical) support; they will never use your data for any other purpose. Under the agreement we have entered into with them, Shopify is obliged to implement appropriate security measures. These security measures consist of the use of SSL encryption and a strong password policy. Shopify is a certified processor of credit card data. Shopify uses cookies to collect technical information relating to your use of the software; no personal data is collected and/or stored. Shopify reserves the right to share collected data within its own group of companies in order to further improve its services. Shopify complies with the applicable statutory retention periods for (personal) data. The EU-US Privacy Shield applies; your data may be processed in the United States.

Web hosting

Hostnet.

We use Hostnet’s web hosting and email services. Hostnet processes personal data on our behalf and does not use your data for its own purposes. However, this party may collect metadata relating to the use of the services. This does not constitute personal data. Hostnet has implemented appropriate technical and organisational measures to prevent the loss and unauthorised use of your personal data. Hostnet is bound by a confidentiality agreement.

Email and mailing lists

Gmail.

We use the services of Gmail for our regular business email communication. This party has taken appropriate technical and organizational measures to prevent abuse, loss, and corruption of your and our data as much as possible. Gmail does not have access to our mailbox, and we treat all our email communication confidentially.

Payment processors

Shopify Pay.

We use the Shopify Pay platform to process some or all of the payments in our online shop. Shopify Pay processes your name, address and place of residence, as well as your payment details such as your bank account or credit card number. Shopify Pay has put in place appropriate technical and organisational measures to protect your personal data. Shopify Pay reserves the right to use your data to further improve its services and, in that context, to share (anonymised) data with third parties. In the event of a request for deferred payment (credit facility), Shopify Pay shares personal data and information relating to your financial position with credit reference agencies. All the safeguards mentioned above regarding the protection of your personal data also apply to those parts of Shopify Pay’s services for which it engages third parties. Shopify Pay does not retain your data for longer than is permitted under the statutory time limits.

Shipping and logistics

Vasco Fulfilment and PostNL.

When you place an order with us, it is our responsibility to have your package delivered to you. We use the services of Vasco and PostNL for carrying out the deliveries. Therefore, we need to share your name, address, and city information with Vasco and PostNL. Vasco and PostNL only use this data for the purpose of executing the agreement. In the event that Vasco and PostNL engage subcontractors, Vasco and PostNL also provide your data to these parties.

Invoicing and accounting

Exact.

We use the services of Exact.nl to manage our administration and accounts. We share your name, address and place of residence, as well as details relating to your order. This information is used to process sales invoices. Your personal data is transmitted and stored securely. Exact is bound by a duty of confidentiality and will treat your data as confidential. Exact will not use your personal data for any purposes other than those described above.

Purpose of data processing

General purpose of the processing.

We use your data solely for the purpose of our services. This means that the purpose of the processing is always directly related to the assignment you provide. We do not use your data for (targeted) marketing. If you share data with us and we use this data to contact you at a later time - other than at your request - we will explicitly ask for your permission. Your data is not shared with third parties, except to comply with accounting and other administrative obligations. These third parties are all bound by confidentiality based on the agreement between them and us or by an oath or legal obligation.

Automatically collected data.

Data automatically collected by our website is processed with the aim of further improving our services. This data (such as your IP address, web browser, and operating system) is not personal data.

Cooperation in fiscal and criminal investigations.

In cases where necessary, Ziemi services BV may be obligated to share your data due to a legal requirement related to fiscal or criminal investigations by the authorities. In such a situation, we are compelled to share your data, but we will resist it within the limits allowed by the law.

Retention periods.

We will keep your data as long as you are a client of ours. This means that we will keep your customer profile until you indicate that you no longer wish to use our services. If you inform us of this, we will also consider it as a request to be forgotten. This also means that we will not keep your data for longer than two years from the last contact moment or transaction, unless there is a legal justification for it. Based on applicable administrative obligations, we are required to keep invoices with your (personal) data, so we will keep this data for as long as the applicable term runs. However, employees will no longer have access to your client profile and documents that we have produced as a result of your order.

Your rights

Under the current Dutch and European legislation, you as a data subject have certain rights regarding the personal data processed by or on behalf of us. We will explain below what these rights are and how you can invoke them. In principle, to prevent abuse, we only send copies of your data to your email address already known to us. In case you wish to receive the data at a different email address or by post, we will ask you to provide identification. We keep a record of processed requests, and in the case of a request for erasure, we keep anonymized data. All copies of data will be provided in the machine-readable data format used within our systems. You have the right at all times to file a complaint with the Dutch Data Protection Authority if you suspect that we are using your personal data inappropriately.

Right of withdrawal.

You always have the right to access the data that we (have) processed or that are related to you or can be traced back to you. You can make a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you a copy of all data, along with an overview of the processors who have this data, to the email address we have on file, specifying the category under which we have stored this data.

Right of rectification.

You always have the right to have the data that we process (or have processed) and that relate to your person or can be traced back to you, adjusted. You can make a request to that effect to our privacy contact person. You will then receive a response to your request within 30 days. If your request is granted, we will send you a confirmation that the data has been adjusted to the email address we have on file.

Right to restriction of processing.

You always have the right to restrict the processing of data related to your person or identifiable as such, which we (have) processed. You can make a request to that effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you a confirmation to the email address we have on file, stating that the data will no longer be processed until you lift the restriction.

Right to data portability.

You always have the right to have the data that we process (or have processed) and that relate to your person or are traceable to you, carried out by another party. You can make a request to this effect to our privacy contact person. You will receive a response to your request within 30 days. If your request is granted, we will send you copies or duplicates of all data about you that we have processed or that have been processed on our behalf by other processors or third parties, to the email address we have on file. In all likelihood, in such a case, we will no longer be able to continue providing services, as the secure linking of data files can no longer be guaranteed. Right of objection and other rights. In case of any objections, you have the right to object to the processing of your personal data by or on behalf of Ziemi services BV. If you object, we will immediately cease the data processing pending the handling of your objection. If your objection is justified, we will provide you with copies of the data we (have) processed and then permanently cease the processing. You also have the right not to be subject to automated individual decision-making or profiling. We do not process your data in a way that this right applies. If you believe otherwise, please contact our privacy contact person.

Cookies

Google Analytics. Cookies from the US company Google are placed via our website as part of the ‘Analytics’ service. We use this service to track and receive reports on how visitors use the website. This data processor may be obliged, under applicable laws and regulations, to grant access to this data. We collect information about your browsing behaviour and share this data with Google. Google may interpret this information in conjunction with other datasets and thereby track your movements on the internet. Google uses this information to provide, amongst other things, targeted adverts (AdWords) and other Google services and products.

Third-party cookies. Where third-party software solutions use cookies, this is stated in this privacy policy.

Changes to the privacy policy. We reserve the right to amend our privacy policy at any time. However, you will always find the most recent version on this page. If the new privacy policy affects the way in which we process data we have already collected about you, we will notify you of this by email.
